Terms of Use (End User License Agreement) — Lantern Garden

By downloading, installing, or using Lantern Garden (the "App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms are between you and Hamdy Mokhtar Sherif only — not with Apple or Google.

1. Eligibility

You must be at least 13 years old (or the minimum digital age in your region) to use the App. If you are a minor, you confirm your parent or guardian permits your use.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on any device you own or control, solely for your personal, non-commercial entertainment, subject to these Terms and the applicable app-store rules (Apple Media Services Terms / Google Play Terms of Service).

3. Virtual items and in-app purchases

• The App offers optional in-app purchases (e.g. coins, gems, boosters, "Remove

Ads"). All purchases are processed by Apple or Google, not by us.

• Virtual items and currencies have no monetary or real-world value, cannot be

exchanged for cash, and are non-transferable outside the App.

• Consumable items are consumed when used and are not restorable. Non-consumable

entitlements (e.g. "Remove Ads") can be restored via the store.

• Except where required by law or store policy, **all purchases are final and

non-refundable.** Refund requests are handled by Apple/Google under their terms.

• We may change, suspend, or discontinue virtual items or their pricing at any

time; nothing here entitles you to a specific virtual item.

4. Acceptable use

You agree not to: reverse-engineer, decompile, or modify the App except as permitted by law; cheat, exploit bugs, or use unauthorized third-party software to gain an unfair advantage; disrupt or attack our or our providers' systems; or use the App for any unlawful purpose.

5. Our content and intellectual property

The App, including its art, audio, code, and "Lantern Garden" branding, is owned by us or our licensors and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or content beyond the license in §2.

6. Updates and availability

We may update, modify, or discontinue the App (or features, including virtual items) at any time. The App may be unavailable during maintenance or for reasons outside our control.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US (OR VIA THE APP STORES FOR THE APP) IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 50, WHICHEVER IS GREATER. Some jurisdictions do not allow these limits, so they may not fully apply to you.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms, to the extent permitted by law.

10. Termination

These Terms apply until terminated. We may suspend or terminate your license if you breach them. You may terminate by deleting the App. Sections that by their nature should survive (e.g. §§3, 5, 7–9, 12) survive termination.

11. Changes to these Terms

We may update these Terms; the Effective date above reflects the latest version. Continued use after changes means you accept them.

12. Governing law

These Terms are governed by the laws of United Arab Emirates, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless mandatory local law provides otherwise.

13. App Store (Apple) additional terms

If you obtained the App from the Apple App Store, the following apply and prevail over any conflicting term for your use on Apple platforms:

1. These Terms are between you and us only, not with Apple. Apple is not

responsible for the App or its content.

1. Apple has no obligation to furnish any maintenance or support for the App;

support requests should go to lanterngarden.app@gmail.com.

1. Apple is not responsible for any product warranties. In the event of any

failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

1. Apple is not responsible for addressing any claims by you or a third party

relating to the App or your use of it, including product-liability, legal/ regulatory, or consumer-protection claims.

1. If a third party claims the App infringes intellectual-property rights, we,

not Apple, are responsible for the investigation, defense, settlement, and discharge of any such claim.

1. You represent that you are not located in a country subject to a U.S.-Government

embargo or designated a "terrorist supporting" country, and that you are not on any U.S.-Government list of prohibited or restricted parties.

1. You must comply with applicable third-party terms of agreement when using the

App.

1. **Apple and Apple's subsidiaries are third-party beneficiaries of these Terms

and, upon your acceptance, have the right to enforce them against you.**

14. Google Play additional terms

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
